OVERVIEW

This website and associated services are operated by Season Label Pty Ltd ACN 159 998 562 (ABN 43 159 998 562) trading as Bondi Longevity ("Bondi Longevity", "we", "us", "our"), registered in New South Wales, Australia.

Bondi Longevity is a primarily private-pay, telehealth-based health optimisation platform. Consultation fees, clinical intake fees, and any treatment-related fees disclosed to you during the pathway are payable directly by patients and are generally not covered by Medicare. Where a treating doctor determines it is clinically appropriate following consultation, they may order pathology or other services through Medicare-funded channels at their clinical discretion. All clinical decisions are made exclusively by independent, AHPRA-registered medical practitioners. The platform coordinates access to clinicians and manages care logistics - it does not direct, incentivise, or influence clinical or prescribing decisions.

By accessing this site, creating an account, submitting an intake form, booking a consultation, making payment, placing an order, or otherwise engaging our services, you (the "Patient") agree to these Terms and Conditions ("Terms"). If you do not agree, please discontinue use immediately. We may update these Terms at any time by posting a revised version to this page. Continued use constitutes acceptance. We will take reasonable steps to notify registered patients of any material changes before they take effect.

1. ELIGIBILITY

A mandatory eligibility screen must be completed before any patient may proceed to booking or payment. The following are absolute exclusions - no payment is taken and no service is provided:

• Under 18 years of age

• Pregnant or breastfeeding

• WADA / anti-doping regulated athlete

• Active cancer treatment

Other health factors may be referred for clinical review before the process continues. By proceeding, you confirm you meet the eligibility criteria, are at least 18, have legal capacity to contract, are located in Australia, and that all information you provide is accurate and complete.

Misrepresentation of identity, medical history, or eligibility may constitute a serious misrepresentation and may result in immediate termination of care and legal action.

2. OUR CLINICAL MODEL

2.1 Sequenced Clinical Pathway

Our service operates as a sequenced, clinically governed pathway. Each stage must be completed before the next proceeds. The pathway may include an eligibility screen, clinical intake, independent triage, baseline pathology, telehealth consultation, independent treatment decision, and where medication is prescribed, structured ongoing monitoring. By engaging our services you agree to participate in this pathway, to receive all associated services - including where applicable the dispensing of prescribed medication - through our coordinated system, and to our applicable fees, all in accordance with these Terms.

2.2 Prescriber Independence

Your treating doctor is a fully independent clinician. Their remuneration is entirely unconnected to prescribing decisions - no financial or commercial incentive exists to prescribe or not prescribe. Only an AHPRA-registered medical practitioner may issue a prescription through our platform.

2.3 Medication - Informed Consent and Payment

Where medication is clinically appropriate, your doctor will discuss the recommended treatment - including risks, benefits, alternatives, and cost - before you make any decision. Your election to proceed, and the associated payment, occurs after that clinical discussion. It is your informed choice. Consent is voluntary and may be withheld at any stage.

Once you confirm and payment is received, your doctor writes and sends a prescription to our partnered compounding pharmacy. Where you proceed through the Bondi Longevity pathway, any prescribed compounded medication is arranged through licensed Australian compounding pharmacy partners involved in that pathway.

2.4 Ongoing Monitoring

Patients receiving prescribed medication may be asked to participate in ongoing monitoring, including check-ins and recommended follow-up consultations, as determined by their treating doctor. You agree to engage honestly with this process and to contact us or your treating doctor promptly if you experience any adverse reaction or side effect.

2.5 Medicines, Compounded Medication and Supplements

Where treatment is recommended or prescribed through our platform, it may involve commercially available registered medicines, compounded medicines, non-prescription supplements, or other health-related products or services, depending on your circumstances and your treating doctor’s independent clinical judgement.

Where a compounded medicine is prescribed, it is prepared specifically for you as an individual by a licensed Australian compounding pharmacy, on the basis of your treating doctor’s prescription.

Your treating doctor will explain the nature of any prescribed treatment, including whether it involves a registered medicine or a compounded medicine, as part of the consent discussion described in Section 2.3.

Non-prescription supplements or wellness products do not replace medical advice, diagnosis, or treatment. You must disclose all medicines, supplements, peptides, performance products, and other health-related products you are using so your treating doctor can consider them as part of your clinical assessment.

3. PATIENT OBLIGATIONS

By engaging our services, you acknowledge and agree that:

• Your treating doctor’s clinical assessment and any prescribing decision is based entirely on the information you provide. Our service is delivered via telehealth and does not involve physical examination. The accuracy and completeness of your disclosure is therefore the foundation of your clinical care;

• You must disclose fully and accurately: your complete medical history including existing and prior conditions; all current and recent medications - including prescription medicines, over-the-counter products, vitamins, minerals, supplements, herbal preparations, peptides, and any other compounds obtained from any source; any substances used for health, performance, body composition, or general wellness purposes; and any matters you would reasonably consider relevant to a doctor making a prescribing decision;

• You must disclose any current or recent prescriptions for the same or substantially similar treatments obtained from any other practitioner or service. Obtaining equivalent treatment from multiple providers without disclosure is clinically unsafe and is not permitted;

• You must promptly notify us of any material change to your health, medications, or circumstances during your ongoing care - including new diagnoses, new medications or supplements commenced after your initial consultation, and any adverse reactions or side effects experienced;

• Where you have withheld or misrepresented information that was material to your treating doctor’s clinical assessment or prescribing decision, responsibility for any adverse outcome arising from that non-disclosure rests with you. Withholding or misrepresenting material information is also grounds for immediate termination of care;

• Treatments carry inherent risks and potential side effects, which your treating practitioner will explain before you consent;

• Treatment outcomes are not guaranteed and will vary between individuals;

• If you are or may be subject to anti-doping regulations, it is your sole responsibility to verify compliance before proceeding;

• All prescribed products are for your personal use only - sharing, reselling, or transferring prescribed medication is illegal; and

• You are responsible for following all prescribed dosage, administration, and storage instructions, and for seeking advice promptly if adverse effects occur.

4. LIMITATIONS OF SERVICE

Bondi Longevity is a health optimisation platform, not an acute or emergency care service. If you are experiencing a medical emergency, call 000 immediately or attend your nearest emergency department.

Our services are delivered via telehealth technology. Where a scheduled consultation cannot proceed due to a technical failure on our part, we will reschedule at no additional charge. We are not liable for interruptions to connectivity arising on your end or through third-party telecommunications infrastructure.

5. FEES, PAYMENT AND REFUNDS

Fees apply at each stage of the care pathway and are disclosed before payment is taken. All prices are in Australian Dollars inclusive of GST unless stated otherwise. Fees may be updated from time to time; any change applies only to stages of the pathway not yet commenced at the date of the change.

All payments are processed via secure encrypted methods. By providing payment details, you authorise us or our third-party payment processor to charge your selected payment method for the relevant fees disclosed to you. If you dispute a charge, notify us with supporting information within seven (7) days at info@bondilongevity.com.

Refunds are structured as follows:

• If you are assessed during clinical intake as not meeting our clinical criteria before a triage consultation has taken place - a refund will be issued of any fees paid, minus any reasonable administrative costs incurred; contact us to discuss

• If your doctor determines at triage that it is not clinically appropriate for you to proceed - a refund of any consultation fees paid will be issued; any clinical intake fees already incurred are non-refundable

• Where pathology has been completed but a consultation does not proceed or is declined by the treating doctor - pathology fees are non-refundable; contact us to discuss further pathway options

• Once a consultation is completed - consultation fees are non-refundable

• Once compounding has commenced - medication fees are non-refundable

• Where an error on our part has caused an incorrect charge - contact us for review

Nothing here limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded by law, and you are entitled to a remedy for any major failure.

6. DELIVERY AND RISK

Once medication has been dispatched, delivery is handled by the relevant courier or fulfilment provider. Delivery timeframes are estimates only and are not guaranteed. You are responsible for providing accurate delivery details and being available to receive deliveries, including temperature-sensitive items where applicable. We are not responsible for delays, failed delivery, loss, spoilage, or additional costs arising from incorrect delivery details supplied by you, failure to collect a delivery, or failure to be available to receive temperature-sensitive items, except to the extent required by law.

If an item is lost, delayed, damaged, or otherwise affected in transit, you must notify us promptly so we can assist with the relevant courier, pharmacy, or supplier process. Any delivery timeframe provided is an estimate only and is not guaranteed. Nothing in this clause limits your rights under the Australian Consumer Law in respect of product quality or fitness for purpose. Title passes upon delivery and full payment.

7. CANCELLATIONS AND NO-SHOWS

Please provide at least 48 hours notice to cancel or reschedule. Late cancellations or non-attendance without notice will attract a cancellation fee of up to the value of the scheduled appointment fee. Full details are set out in our Cancellation Policy at bondilongevity.com.

8. PRIVACY AND HEALTH INFORMATION

We handle all personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, the Health Records and Information Privacy Act 2002 (NSW), and our Privacy Policy at bondilongevity.com. Our Privacy Policy contains full detail of how we collect, use, store, and disclose your information and should be read alongside these Terms.

8.1 What We Collect

In the course of providing our services we collect: identity and contact information; health history, symptoms, and clinical intake responses; pathology results and clinical correspondence; prescribing and dispensing records; payment information; and communications between you and our platform. Health information is sensitive information under applicable law and is handled accordingly.

8.2 How We Use and Share Your Information

Your information is used to coordinate and deliver your clinical care. This includes sharing relevant health information with your treating practitioner so they can assess you and make independent clinical decisions; with our compounding pharmacy partners to fulfil any prescription; and with pathology providers where testing is ordered. By engaging our services, you consent to these disclosures as necessary to deliver your care. We do not sell patient data or disclose health information for marketing purposes.

8.3 Connected Health Data and Wearable Devices

We may offer integration with third-party health data platforms that allow you to connect wearable devices and health monitoring tools to share data such as activity, sleep, cardiovascular metrics, body composition, and continuous glucose readings. This integration is entirely optional. Participation does not affect your ability to access our clinical services.

Where you choose to connect a wearable or health data integration, the data you share through that platform may be made available to your treating practitioner to assist with clinical assessment and ongoing monitoring. That data forms part of your clinical record held by us. You may disconnect any integration at any time; historical data already shared will be retained in accordance with our record-keeping obligations.

Third-party health data platforms operate under their own terms of service and privacy policies. Where any such platform stores or processes data outside Australia, your information may be subject to the laws of that jurisdiction rather than Australian privacy law. We take reasonable steps to engage platforms that maintain appropriate data security standards, and will notify you of any material overseas data flows in our Privacy Policy.

8.4 Retention and Your Rights

Health records are retained for the minimum periods required by applicable law. You have the right to access, correct, and in certain circumstances request deletion of your personal information, subject to our legal obligations to retain clinical records. 9. WEBSITE CONTENT

Content on this website is for general informational purposes only and does not constitute medical advice. We may modify or remove content at any time. We make no warranty that the site will be uninterrupted or error-free.

10. INTELLECTUAL PROPERTY

All website content is the property of Season Label Pty Ltd trading as Bondi Longevity or its licensors, protected under Australian and international law. No content may be reproduced or commercially exploited without our prior written consent.

11. PROHIBITED USES

You must not use our website or services for any unlawful purpose; to misrepresent your identity or eligibility; to upload harmful code; to harvest personal information; to interfere with site security; or to resell or transfer prescribed products. We may terminate access immediately for any breach.

12. THIRD-PARTY SERVICES

Our platform works with third-party providers including clinical software, compounding pharmacies, pathology services, and fulfilment partners. These providers operate under their own terms. Our compounding pharmacy partners are required to hold applicable Australian pharmacy licences and professional accreditations. Compounding decisions are made by the pharmacy independently, in accordance with their own professional and regulatory obligations. We are not liable for independent clinical or dispensing decisions made by our providers, nor for the content or conduct of other third-party services. Nothing in this clause limits your rights under the Australian Consumer Law.

13. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts, or modifies any right or guarantee you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

To the maximum extent permitted by law, our liability for any claim arising under or in connection with these Terms is limited to the greater of:

(a) the total fees paid by you to us for the specific product or service giving rise to the claim; or

(b) five hundred Australian dollars ($500).

This limitation does not apply to liability that cannot lawfully be excluded, restricted, or modified, including liability arising from fraud, wilful misconduct, gross negligence, or breach of any non-excludable consumer guarantee.

14. INDEMNIFICATION

You are responsible for any claim, loss, or expense we reasonably incur as a direct result of: your deliberate misconduct or unlawful conduct; material misrepresentation of your health, identity, or eligibility; serious breach of these Terms; or any deliberate and unauthorised attempt to fulfil a prescription through an alternative pharmacy without notifying us. This responsibility does not apply to the extent that the relevant loss, claim, or expense was caused or contributed to by us, a treating practitioner, a pharmacy partner, or another third-party provider involved in your care.

15. TERMINATION

We may suspend or terminate your access at any time where you breach these Terms, provide false information, or where continued care is not clinically appropriate. Outstanding payment obligations survive termination.

16. RECOVERY OF LEGAL COSTS

To the extent permitted by law, if legal action is required to recover amounts owed by you, you may be ordered to pay our reasonable legal costs, as determined by the relevant court or tribunal.

17. COMPLAINTS AND GOVERNING LAW

To raise a complaint, contact info@bondilongevity.com. We will acknowledge within two (2) business days and aim to resolve within ten (10) business days. Complaints about a registered health practitioner may be referred to AHPRA (www.ahpra.gov.au). NSW patients may also contact the Health Care Complaints Commission (www.hccc.nsw.gov.au); patients in other states and territories should refer to their applicable state health complaints body. Complaints relating to pharmacy services may be referred to the Pharmacy Board of Australia via AHPRA. Adverse events related to therapeutic goods may be reported to the Therapeutic Goods Administration (www.tga.gov.au).

These Terms are governed by the laws of New South Wales. Unresolved disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.

18. GENERAL

These Terms, together with our Privacy Policy, Refunds and Returns Policy, and Cancellation Policy, form the entire agreement between you and Bondi Longevity. If any provision is unenforceable, the remainder continues in full force. Failure to enforce any provision is not a waiver. You may not assign your rights without our consent. We may assign our rights to a successor entity carrying on the same business, provided that your rights under these Terms are not diminished. We are not liable for failures caused by circumstances beyond our reasonable control. Where such circumstances affect your care pathway, we will take reasonable steps to notify you promptly and to minimise disruption to your treatment, including facilitating continuity of care where possible.
